Once again, I say that if I were the owner of Kombat Kennels, I would immediately hire a lawyer, find the "neighbor" that is responsible. Which would not be that hard considering, she walks Wrigley, every night and file suit against her for defamation and if he wanted to take the time he should attempt to obtain the contact information for anyone on this thread that has not stated factual information about HIS Kennel or his DOGS.
Actually it's not that easy to sue somebody for defamation through cyber law.
Obviously since the two parties involved are from the same state they have the luxury of overcoming the little hurdle of which state does the case go to court is as different states/provinces have different legal courses of action and reprocussion.
However there are still a few more problems to overcome... mainly that this forum is not a publication and is in no way declared official, binding or pretending to be text book type informtation, so you'll have a harder time proving libel based on the fact that the information distributed on this forum is strictly opinion based. If it had been some form of official publication you wouldn't have that problem, however it's not.
The next problem you'll run into is that when the owner of Kombat joined the forum and was asked to correct the mis-information that has apparently been posted, it was not. When asked what testing was done, which could have easily silenced and caused retractions from many members here, the responce was with snide comments such as "we aren't all that lucky" or some such thing.
Furthermore you have now gone ahead and made slanderous remarks at several forum members as to there quality of person, and some of the remarks as made by kombat kennels can be interpreted as threats to the original poster. Now whether they were meant as such isn't as relevant as the fact that they were phrased in the manner that could be interpreted as a threat, knowning that this person is also a neighbour of combat kennels and the fact that you've both now stated that you know whom to look for based on her dog. Not very many courts will appreciate a libel case that also contains threats of violence against the person being sued for libel. And there is always the posibility of a countersuit.
The next problem is that in order to sue the original poster, or any of the posters of this thread you also have to sue chazhound, the owner of this forum as it is there medium and they are technically responsible for all posts and opinions as expressed on this website.
Now your of course back to crossing state lines when you start dragging multiple people into this. Of course I'd assume you'd pick the court that would favour you the most however that doesn't always work out as you plan.
Of course dragging multiple chazhound members (including chazhound themself) into a libel suit could earn you some shiny new pennies... however the last problem your looking at facing is the fact that chazhound members would likely unite and donate to a pool to afford a much better lawyer/legal council. Increasing your own chances of loosing this case, which would result in not only having to pay your own legal fees, but also the legal fees of the person(s) you are attempting to sue.
So while I imagine the posibility of winning makes it an appealing course of action, the prospect of getting a case like this off the ground and the posibility of loosing would make it slightly less appealing.
