That's mostly why I'm so annoyed with myself. If I had actually LOOKED at where the sensor was while the guy was here there was no way I would have believed him :/

The last couple of shots I took were the ONLY visible damage on the box at all. It just looked so minor I didn't think anything of it when I saw it. I think I was just so excited to get the thing inside I was too lenient.

As for the TV itself, I don't know the size or type really. That's my husband's thing. I know it's flat screen and weighs about 150 pounds, and larger than our other TV.. Which I also have no idea of the size :p

Holy!! 5k for a TV that was supposed to be 7k?!

We took a chance when we ordered our TV... it's a 55 inch Plasma and we paid about 2k for it two years ago. It's great and I love it. I am glad that my husband planned to stay home that day so he could be there when the truck guy delivers... he made him open the box and inspected the TV, even the truck guy was being an ass and rushing him.

I hope you guys get another TV!! That sucks!

That's why I wish my husband had been here. He would have checked it a lot more carefully, and would have opened it while the driver was still here. Unfortunately he had to go back to California for a few days to do some contract work which we didn't find out until 2 days before the already scheduled delivery.

I just hope they don't say "Oh well, you accepted it too bad"

Pretty sure my husband paid for insurance on it as well. He'll be home tonight so we'll be able to get the claims form faxed either tomorrow or Monday, depending on whether he needs to get paperwork from his office.

One thing is for sure though, if we get another one it will be completely unpacked before the driver leaves.

Another issue is how you paid for it. I know you said you went through ebay, does that also mean you went through paypal? If you did, paypal has a pretty good system for BUYERS.........not so good for sellers, LOL

And if you used a CC through paypal, even better.........you can contact the CC company and fill them in on what's going on which will make THEM stop payment to paypal and paypal will jerk the money away from that seller :D

We did in fact use a credit card through paypal. My husband did mention that he sent an email to the seller to ask for advice, and honestly I'd hate to take it out on him since it really wasn't his fault. Not to mention we'd still like to get the TV, and will probably order another from the same seller once this is resolved. I'm hoping the seller can help us out with the shipping company as well because I know he uses them for all the TV's he sells. The driver mentioned he bought the same TV too

I understand that it really wasn't the seller's fault.............at least as far as you know (you can never be sure what people will do for insurance scams). But HE is the one who does/should have insured it with the shipping company and he should be reimbursed by them.

I would definitely have your CC and Paypal jerk the money back from the seller (before it's too late and YOU are out 5k) and let the seller deal with the shippers............no question in my mind what I would do.

My husband got home last night and I let him know what you guys recommended about paypal and the credit card. I know the seller got back to him and asked him a bunch of questions about the shipment, and not sure where it went from there. The credit card would have been charged probably about a week or two ago when we ordered it, so wouldn't it be too late to get the money back that way anyways? And I found out that we did pay for insurance on it as well, so I imagine it'll have to be covered one way or another.

Go ahead and notify the CC company and Paypal. They can still pull the money back out and credit it to your account, plus, you don't need to be liable for the interest on it while this is being settled!

Too, if by some chance the merchant and shipping companies DON'T handle this properly, you won't have lost five grand!

Well, we've got some progress. The inspector came out on Tuesday and faxed his report and photos to the shipping company that day. I didn't call on Wens or Thurs since that's when my husband takes his weekend and frankly I just needed the time to not think about it. I got the my copy of the inspector's report today and it actually looks quite good for us so I called the shipping company. They are going to settle, but they are trying to settle for less than the cost of the TV, claiming they can only pay $25 per pound.. But they said it weighs less than it does. So I'll get that straightened out with them. We also got a response from the seller after we updated him, and he told us once we got the reimbursement from the shipping company, that he will sell us another TV for the amount we get reimbursed! :)

I'll be a little more at ease when we've got that check in our hand, but I feel a bit better now :)

THat is what FEdx did to my friend Kelly. They accepted it not seeing the hole that was knocked in the side..that went through and damaged it severly. THey said she accepted that was that. I thought Fedx was reputable, i was surprised.

Glad it's mostly settled... I'd be livid!!!

To be honest though... If those guys are such liars that they removed the sensor, I would probably have been scared to open the box or look at it. Who knows what that guy would have done...

Wait. Where's your original $5000 then?

SOMEONE in shipping committed fraud by removing the sensor. You hold the cards. Don't let them screw you, which is what they're doing.

Call the card company, contact PayPal and GET YOUR MONEY BACK.
