So I made a GIANT list, I'll drop some when you answer my shyness question. Make sure you are honest with yourself about energy levels you want. Remember that when you say, have a child, you need to think about whether or not the dog would get enough exercise and stimulation. Here are some from my list, these are the ones that mention a high energy level/good hiking partner/agility dog, etc. in their description. Many dogs descriptions don't though, even though they very well may be. I also know nothing about NC so I don't know how close/far some of these guys are from you.

Wow, what a great list! Many of those I'd found already, or discounted for reasons of preference, but some I hadn't seen! I did contact a couple of my favorites from the list and am waiting to hear back from them with more info! 1, 5, 6 and 8 were my faves from that list that I would pursue, but will pursue my 2nd choices if those don't work out...it's hard to narrow it down sometimes without meeting the dog and interacting with it! Trying to keep an open mind, so will likely be contacting the ones closest to me regardless, since I can see them easily.

There are breeds bans here, the typical: no rotties, GSDs, pits, mastiffs, dobies and more that I can't recall off the top of my head. But they're all large breeds (all of my favorite breeds basically).

I also stopped by the shelter today and spoke to a volunteer there who was able to show me to a dog that just came in that she thought would work for me that I fell in love with (who am I kidding though, all dogs steal my heart!). So thanks for that suggestion!! The dog weighs about 37lbs, and I have to see how my hubby gets along with her, and if that will fly with my facility, she looks like some sort of beagle/lab/shepherd/boxer/??? cross, but I'm thinking between her, or one of my petfinder finds it will work out and hubby and I will get the right dog for us, without having to move (yay! our location is so ideal! our apt even has a backyard)

I can't say thank you enough for everyone's input! I didn't realize how many dogs that I could find in that size range that would meet my needs! This thread has been a great eye opener for me, (especially considering how discouraged i felt when I found out about the 35lb limit!) and I will post for sure an update on the shelter dog I found today if she works out, and if one of the petfinder finds works out for us! I know everyone loves a happy ending! :)

You can also find some Aussies on the lower end of the weight spectrum. My (former) boy Django is 33-35 pounds depending on the season. Yes, he has a coat, but in all actuality, he sheds far less than my Doberman. He was never a barker when I lived with him, but his "dad" has let him get away with murder since I moved out. And actually, when I go dogsit, he doesn't bark either. Smart boy. ;)
