purchased a sick puppy

Okay I purchased a dog from a person who I thought was a responcible breeder at the time of purchase. The website and the questionare really had me fooled. Anyways when I got the puppy I noticed that she was peeing uncontrollably (If the lady was a good breeder she would have noticed this) so when I took the puppy to the vet for her first check up I told the vet of this problem and he did blood work and found that she had a kidney infection, so he put her on anti biotics. Four weeks later the puppies infection was gone but she had crystals in her urine so he put her on a special diet and with that was able to get ride of the crystals. And then on the last test he found that she wasn't condencing urine like she should be so he had to do more test for that. He finally came to the conclusion that the puppy has weak kidneys and she will have to be closly monitored as this problem may get worse. I called the breeder and told her of the problems with her kidney and all and asked if I could be reinbursed for cost of some of the vet bills which was somewhere in the ball park of 1000 dollars. The puppy has a warranty and all but that warranty states that I need to return the puppy and I will only get another puppy from her next liter in return. I would have been happy with some sympathy but instead I got an earful because I told the lady that I didn't want to return the puppy to her and get another one because I had doubts about her breeding program. Does anyone know if I have any legal ground to stand on here and will I be able to get reinbursed for the cost of the vet bills on the puppy as the puppy has been sick since they day I got her.

You signed the contract, what does the contract say?

The contract says that the puppy is to be free of congenital diseases and hip displaycia for one year. If the puppy is to be found with any of these I am to return it to the breeder and another puppy will be given. The contract also said the puppy will have a microchip but it didn't so I paid to get one implanted and the breeder said she will pay for that but not the activation for for it.

Sad to say that you would probably spend more fighting a contract that you signed than it would be worth to just eat the cost.

I wouldn't count of it, the contract would have to state that she is willing to pay in full or inpart for vet bills, or that she is willing to give you your money back infull or part to help pay the vet bills.
So unless you return the pup and get another one, you are SOL.

Yeah, I'm sorry, but I don't think you have any legal ground.

What breed is the puppy? Who is the breeder?

While this situation sounds horrible, I am not going to jump on the bandwagon just yet that this is a horrible breeder. Probably so...but I think it's easy to judge when I don't know all the details. I can see a breeder missing the signs of a puppy with a urinary/kidney disorder pretty easily. Young puppies pee very frequently and with a litter of them, you can't keep track of who's pee is whose and who is going when etc. It's a pile of pups and they are all eliminating quite frequently, all day.

This is why I personally would not buy from a breeder that only offers a puppy back upon the sick pups return. Most breeders know that the person won't want to part with the pup. My contract states that if the puppy is ill, you can keep it if you choose AND you get your money back.

I feel for you. A new pup is suppose to be a really great, fun time. Hopefully everything turns out alright and the pup pulls through.
