Here if the driver doesn't have insurance you are pretty much screwed ... Even if you have insurance ... I can't imagine having to deal with the no insurance factor if I were riding a bike. I don't know the laws here but I can't imagine that are supportive.

If she was WALKING her bike in the crosswalk, then she should have any medical bills/property damage covered by the driver--just as though she were a pedestrian.

If she was riding it in the crosswalk though, she's going to have a harder time arguing her case. A friend in college got hit by a car on his razor scooter while in a crosswalk, and he was deemed at fault, because, as the police said, "Crosswalks are for walking, not scootering" :(

Regardless, I'd call the police and file a report, just so it's on record.

It depends on local ordinances. In my city, there are areas where bicycles can and can't be ridden on the sidewalk (it has to do with what percentage of the block is residential vs businesses). Where they have to ride on the street, they are legally considered vehicles. Where they can ride on the sidewalk (or when on designated bike paths that cross roads) they are legally considered pedestrians.

It would probably be worth looking up on your city's website, Frostfell.

Sorry, I must have skimmed. I missed the part that she was riding on the sidewalk. Yeah, all bets are off at that point. I just assumed she was crossing the street when she was hit.

Stinks :(

I don't mean to pour salt in a wound but if she had been riding her bike on the road & was hit, she might have had more rights to damages :(

Sucks I know & I am sorry ... I do hope you get some compensation frost fell. But also since you weren't hurt it ls also going to be harder then if you were ... Which also sucks.

In most of Oregon it is perfectly legal to ride on the sidewalk, but there are particular rules about how fast you can enter an intersection. Does not apply to inline skates. Still got hit rollerjoring with Buster though. Lady pulled from a commercial building and stopped at the street. Ran into the side of the car. Technically she should have stopped before the crosswalk, then at the street, but I've never seen anyone do that.

I have a box fan blowing into mine. The processor fan works, but my case is small and crowded. I have to clean out the dog hair soon.

Michigan bike-sidewalk law
257.660c Operation of bicycle upon sidewalk or pedestrian crosswalk.(1) An individual operating a bicycle upon a sidewalk or a pedestrian crosswalk shall yield the right-of-way to pedestrians and shall give an audible signal before overtaking and passing a pedestrian.
(2) An individual shall not operate a bicycle upon a sidewalk or a pedestrian crosswalk if that operation is prohibited by an official traffic control device.

(3) An individual lawfully operating a bicycle upon a sidewalk or a pedestrian crosswalk has all of the rights and responsibilities applicable to a pedestrian using that sidewalk or crosswalk.

Boy they sure are getting a lot of rain EVERYWHERE THAT ISN'T HERE.

Sure would be nice if this drought would end. And by "end" I don't mean dump five feet of snow on us in April and then we don't get any further notable precipitation for the rest of the year.

I now have to take my fully housebroken, 7 and 9 year old dogs out on leashes to potty because they have decided that eating fallen crab apples is more important than relieving themselves, and will then poop in the house. Really dogs? Really???

Got very stressed all the sudden. I close the kennel tonight, which is fine.. but everyone is SO loud and amped up right now. I just.. guh. I don't want to handle this.

I also agreed to babysit from 8 to noon, possibly 3 tomorrow. And then I have a horse to exercise in the evening. Looks like it will be a late night catching up on cleaning that I thought I was getting tomorrow. NOPE! Oh well.

I'm so sorry, it's scary and infuriating. If you need to talk I know how it feels.
I know. :/ That's why I completely lost it for, oh, almost three days.

All I could think was, is she SICK or in PAIN or DYING? Does she suddenly hate me after six years of ****ing BFF-style devotion?

The damage to my face was superficial and, actually, quite conveniently located on the inside of my upper lip and the inside of my left nostril. I have some bruising that I can cover up with makeup, but I won't have scars and it's not painful anymore. It was 100% emotional betrayal.

She bit, clamped down and released, it was over in a second, and it was obviously a defensive bite. But it was a ****ing bite, on my face, from my own dog. She shouldn't have ever felt the need to defend herself from me. I don't know what's going on and I don't like it.

I just had two awful dreams...they were actually a continuation of the same dream. The first involved my sister almost letting my dog (well, Chloe; but apparently my inner demon still says she is mine even though I haven't lived with her for a year and a half now) get hit on a busy road because of sheer stupidity and laziness, completely betraying my trust in her. Then I went home and went to sleep, and thought I heard Mike come into the apartment and start shuffling around in the livingroom/kitchen. I tried to wake up, and couldn't. Then, when I finally did manage to struggle awake, he would be gone, but there would be signs that he had been home. I'd go back to sleep and it would just cycle over and over.

My conscious mind finally said, "Andrea, you are dreaming and this is stupid. Wake up." So I did. But my God, it's not even 10am yet, and I feel like I almost watched my dog die and then missed out on Mike being home. What a sucky start to my day.

Bloo can't come on the flight because the flight listing was not clear when I purchased the ticket. The first leg is american airlines who won't accept brachy dogs.

She needs to be shipped seperately.

We're being charged an extra $250 for the cats.

I can't handle this. I don't want my dog to be shipped separately. I can't afford for her to be. It was supposed to be $300 for all three animals to be shipped, now it's $450 just for the cats.

My car is making a different weird sound now whenever RPM hits 2000+ which is not good at all. Car doesn't FEEL any different but I know something isn't right.

This means i have to pull from an agility trial i had izzie entered for tomorrow. So bummed but it's too risky to drive 2 hours one way to possibly have my car break down with no one to come rescue me.

Sigh. I need a drank.

I really want to own an African gray parrot and have been really interested in wanting a bird lately, but I'm a bit afraid of birds. My parents had a bird when I was growing up that kept trying to bite me. We have a a blue front amazon or whatever at work and I'm at the top of his hit list and he chased me out of a room the other day. So... Ya I'm a little afraid of getting bit by a bird. But yet I still want a gray.

How do I get past my fear?

Ugh. Real world problems.
